Delayed elections – USA Cricket board members file lawsuit against other members, chief executive

Allege numerous improper procedures, five fellow board members and CEO Iain Higgins sued

Peter Della Penna20-Mar-2021Two USA Cricket board members have filed a lawsuit against other board members as well as the chief executive of the organisation, alleging numerous improper procedures tied to the latest cycle of delayed elections. ESPNcricinfo has obtained a copy of the lawsuit, filed on March 8, in which Venu Pisike and Srini Salver filed the claim, and also listed USA Cricket as a co-plaintiff, but in which they have sued five fellow board members along with CEO Iain Higgins.USA Cricket issued a statement late on Friday evening, calling aspects of the suit “meritless” and arguing that fighting the suit could affect plans for the year: “If… it is required to further divert some of those limited resources into defending the organization from meritless legal claims and protecting the rights of its new membership, the Board will have no choice but to consider cutting some of its planned cricketing activities and developmental activities for 2021 and is scheduled to meet early next week to consider which activities must be scaled back.”Related

The dispute, a throwback to the days of the expelled USA Cricket Association (USACA), stems from a series of administrative decisions from November 2020 in which the five board members are alleged to have voted in favour of approving a membership referendum to change voting procedures for the next election. The referendum called for an exception to be made in this election to allow new members to register to vote and grant immediate voting rights rather than allowing voting rights to be given after a 12-month membership, as required in the constitution. The plaintiffs allege that the five board members violated the constitution and claim that the referendum – sent out to USA Cricket’s 725 members at the time in November 2020 – did not receive the 67% supermajority as required. The five are alleged to have voted to approve the referendum with a simple majority (between 51% and 66%) of individual member votes. The lawsuit also alleges that Higgins tampered with the referendum voting process by having access to in-progress tracking of votes electronically submitted ahead of the final voting deadline, and that he directly contacted members who had yet to vote to encourage them to vote in favour of the referendum. In December, USA Cricket claimed that the referendum was approved by the board of directors “alongside independent legal advice that had been obtained from its expert legal counsel”, but didn’t state that it had passed with a 67% supermajority. USA Cricket refused to make public full voting results when asked by ESPNcricinfo, saying it was a “confidential” matter. The consequence of the resolution has been to expand the voting base from 725 members to nearly 20,000. Higgins has previously stated that passing of the referendum was to ensure “a more inclusive governance structure moving forward”. At least 141 leagues were subsequently listed by USA Cricket in which clubs and leagues were eligible to align themselves as part of the expanded individual membership sign-up period ending on March 15.A successful lawsuit could potentially be beneficial to someone like Pisike. Of the 725 members, 232 (32%) were based in Georgia, which is Pisike’s home territory and was a significant factor in his re-election. Expanding that would dilute a power base.In contrast, a board member like Ajith Bhaskar of New York, might gain from expanded membership. Bhaskar, a defendant in the suit, is currently up for reelection and New York is one of several areas believed to have experienced a strong surge in new membership registrations since the referendum was approved.Separately, the lawsuit also alleges that the process to reappoint Paraag Marathe to a second term as board chairman was unconstitutional. Marathe’s first term began following the August 2018 elections, in which seven newly voted-in board members chose him from among three independent directors – Marathe, Catherine Carlson and Rohan Sajdeh – to become the inaugural chairman. Marathe’s initial two-year term on the board technically came to an end last August, but prolonged delays have resulted in another election not yet taking place. The lawsuit claims that by the constitution a new chairman may only be elected following the Annual General Meeting after a constituent election. Currently, the terms of three board members – Suraj Vishwanathan, Bhaskar and Nadia Gruny – are up for re-election. But the lawsuit claims that multiple board members, whose terms have expired in August 2020, were allowed to vote in violation of the constitution to reappoint Marathe, rather than waiting for election results in which potentially different replacements on the board may vote differently. The suit also claims that USA Cricket violated the constitution by not having the current elections and an AGM by November 30, 2020. The constitution states an AGM and elections must be held by the end of November every year. However, there was no AGM or election in 2019, instead delayed to February 2020.The question likely to arise is whether or not a legal interpretation would determine that the February 2020 elections should retroactively be regarded as the 2019 election.Regardless, Pisike and Salver are seeking an injunction to block the current election process from allowing it to continue. Instead, the suit argues that the 725 USA Cricket individual members that were in place as of November 2020 should be the ones allowed to vote and that they have since been disenfranchised by having their memberships, stripped and required to go through a fresh registration process. The suit also seeks to remove Marathe pending the results of the upcoming election.

Aston Villa in advanced talks with £25m "leader" excited to play under Emery

Aston Villa are now thought to be in advanced talks with a £25m “leader” over a potential move to Villa Park, according to Fabrizio Romano.

Aston Villa’s summer signings

NSWE and Monchi have been working hard behind the scenes in the Midlands to bolster Unai Emery’s squad ahead of the upcoming campaign.

With Champions League football on offer at Villa Park, the club have brought in eight new players, three of which have sealed returns to Villa in Ros Barkley, Cameron Archer and Jaden Philogene.

The headline additions in regards to fees have been Amadou Onana and Ian Maatsen, but by the looks of things, more could be on the way before the August 30 deadline.

One specific target to emerge recently has been Feyenoord right-back Lutsharel Geertruida, with initial talks thought to be underway over a potential deal.

Approach made: Aston Villa working to sign "strong" 19 y/o gem for Emery

He’s one for the future.

ByTom Cunningham Aug 14, 2024

Valued at £25m and linked with the likes of Tottenham and Liverpool this year, Geertruida could soon be on his way to the Premier League, with Villa still working to agree personal terms.

Aston Villa in advanced Geertruida talks

Providing a new update on Aston Villa’s talks with Geertruida, Romano, talking to GiveMeSport, said that talks are advanced on the defender’s side, with Geertruida excited at the prospect of working under Emery. However, as of yet, a deal is not close with Feyenoord.

"It's ongoing [Geertruida negotiations], it's not that close yet, it's well advanced on the player's side, because the player is keen on the move to the Premier League and to the Champions League.

"Also in this case, with Aston Villa, he's really attracted by the project of Unai Emery. But with Feyenoord it's always complicated to negotiate for Geertruida. He's a really important player for them and every time important clubs try to approach Feyenoord in recent years, Leipzig last year, PSG at the beginning of this summer transfer window, it has always been a tough story.

"He's a player they love at Feyenoord, and it's never easy to negotiate with Feyenoord for Hanchko, for Geertruida, all their superstars, they love to keep those players at the club."

Lutsharel Geertruida for the Netherlands.

The Netherlands international has been described as a "leader" by football analyst Ben Mattinson on X, who added that Geertruida is both "technically secure" and "aerially strong". Aged 24, Geertruida can also play as a centre-back and even as a holding midfielder if required, as per Transfermarkt, so not only could he rival Matty Cash at right-back, but he’d also offer versatility in other areas.

A move looks like it will be one to watch with Villa being in advanced talks with the player and his representatives, with time ticking until the deadline.

West Brom could finally replace Gayle by signing £12k-p/w star

West Bromwich Albion fans would have been shocked logging into social media last week to see Brandon Thomas-Asante was being linked up with a move up to the Premier League after the former Salford City striker experienced such an up-and-down Championship season.

Thomas-Asante would bag a respectable 11 second-tier strikes during the regular campaign, but his presence in the all-important play-off games that Carlos Corberan's men experienced after this was non-existent, managing a meagre 15 touches of the ball in the first leg before being hauled off by the unhappy Spaniard.

Therefore, if the 25-year-old centre-forward does make a move to the Saints a reality soon, West Brom will no doubt be back in the transfer market for a new attacker to lead the line, having previously been linked with this striker option.

West Brom could go back in for free agent

According to reports from the Daily Mail last week, West Brom have been keen on trying to tempt former Stoke City man Tyrese Campbell to the Hawthorns this coming season, to strengthen their lone striker spot.

They're certainly not alone in their reported advances of the now free-agent attacker, with Rangers up in Scotland named as one interested party, alongside fellow Championship sides in the form of Preston North End, Sheffield United, Queens Park Rangers and more.

Released by the Potters after his injury demons had gotten too out of control, leading to a constantly disrupted 2023/24 campaign, Campbell will hope he can bounce back from these unwanted setbacks and fire in plenty of goals again lining up for a new employer soon.

Why Campbell could finally replace Dwight Gayle

With Josh Maja and Daryl Dike also unreliable options in reserve up top, owing to their own injury issues, this could be a risky move, but one that pays off, especially if Campbell is able to replicate the heroics of Dwight Gayle in Albion colours.

Gayle would also arrive to the Hawthorns off an indifferent spell at Newcastle United himself before bursting into life in his new Championship surroundings, joining on loan for the 2018/19 season after only scoring six Premier League goals the campaign before for the Magpies.

The now 34-year-old free agent would go on to become an instant Baggies legend, netting 24 goals in total when donning his new West Brom strip, from just 41 games.

West Brom haven't had such a prolific goalscorer since their former deadly loanee left, when glancing at the table above, but the Championship outfit will hope Campbell can be that lethal finisher soon, with or without Thomas-Asante staying put.

Described as being a "handful" by former Stoke manager Michael O'Neill when on top form for the Potters, the former £12.5k-per-week man still managed to bag vital goals last season for his now ex-employers, netting a crucial strike away at Southampton towards the back-end of last campaign to keep his side afloat in the second tier.

The injury-prone 24-year-old would only need 15 touches on the South Coast to fire in the winner against Russell Martin's eventually promoted Saints, which would prove to be one of his last goal contributions for Stoke, taking his goal total to 36 from 164 games.

He could well become even more of a goal threat in his new location, surrounded by the likes of Jed Wallace and Grady Diangana teeing up chances for him, as West Brom eye another promotion charge.

Farke’s own Klich: Leeds express interest in signing "exciting" £12m star

Leeds United have less than a week to prepare for their opening day clash with Portsmouth in the Championship at Elland Road on Saturday.

They will be lining up without the league's reigning Player of the Year after Crysencio Summerville's transfer to West Ham United was officially confirmed on Saturday.

The Whites have cashed in on Archie Gray, who moved to Tottenham Hotspur, and Glen Kamara, who left to sign for Rennes, alongside the Dutch forward during the summer transfer window so far.

Daniel Farke has, however, been able to bring in Joe Rodon, Alex Cairns, Jayden Bogle, and Joe Rothwell to bolster his squad across the pitch.

There is still a number of weeks left before the window slams shut for business and this means that Leeds could make further signings to improve the team, with the aim of building a side that is ready to compete for promotion back to the Premier League at the second time of asking.

The West Yorkshire outfit are reportedly looking to make another addition to their midfield ranks as they target a youngster from the top-flight.

Leeds register interest in Premier League teen

According to Football Insider, Leeds have registered a formal interest in Liverpool central midfielder Bobby Clark as they look to land the teenage starlet this summer.

The report claims that the Whites have made a move to sign the England U20 international on a season-long loan from the Premier League giants.

It states that Liverpool are more likely to sanction a loan exit from the talented whiz, rather than allowing him to leave permanently, amid interest from Austrian side RB Salzburg.

Bobby Clark for Liverpool

Football Insider adds that fellow Championship teams Sheffield United and Norwich City are also interested in signing Clark on a season-long loan.

Both clubs are said to be preparing formal offers to land the midfield whiz and it may come down to where Liverpool feel his development is best served.

However, it remains to be seen where the Reds would prefer him to go or where the player himself sees himself playing in the 2024/25 campaign.

This means that it is unclear as to how likely Leeds are to win the race for his services before the summer transfer window slams shut at the end of this month.

If the Whites can come out on top and bring the former Newcastle United youngster to Elland Road, though, then he could be Farke's own version of Mateusz Klich.

Why Mateusz Klich was a key player for Leeds

Marcelo Bielsa's arrival in Yorkshire in the summer of 2018 was a blessing for the club and the players, none more so than the Polish central midfielder.

He had spent the second half of the previous campaign on loan with FC Utrecht in the Netherlands after mustering up just five Championship appearances in the first half.

Bielsa came through the door ahead of the 2018/19 season and clearly saw something he liked in Klich, as the midfield battler was immediately made a key player for him.

As you can see in the table above, the Polish ace started every single game in the regular season before the Whites missed out on promotion via the play-offs.

The right-footed maestro chipped in with 18 direct goal contributions along the way as he showcased his quality as both a scorer and a creator of goals from a midfield role.

Klich followed that up with six goals and five assists in 45 appearances as Leeds won the Championship title the following term, which shows that he remained an important member of the team during a promotion season.

It was then a question of whether or not he could handle the step up to the Premier League and the Poland international answered that in emphatic fashion, with four goals and five assists in 35 outings as the Whites landed a top-half finish in the division.

Overall, the central midfielder, who now plays for D.C United in the MLS, was a key player during the peak years of Bielsa's reign due to his quality as both a scorer and a creator of goals from midfield – providing a big attacking threat from that role.

Why Bobby Clark could be Mateusz Klich 2.0

Clark could come in as Farke's own version of Klich, as an attacking force from a midfield position, if he can enjoy a breakthrough season at first-team level after a smattering of senior appearances for Liverpool last term.

The 19-year-old star, who is reportedly valued at £12m by the Reds, has played 14 games for the Premier League giants and chipped in with one goal and two assists.

Bobby Clark in action for Premier League club Liverpool.

He caught the eye with one goal and one assist in two Europa League outings for Jurgen Klopp, which showed that the quality is there for him to impact matches at a high level.

Clark, who was described as "exciting" by reporter Lee Ryder, has the ability to make things happen at the top end of the pitch from a midfield position, which is also evidenced by his superb form for Liverpool's academy teams.

As you can see in the table above, the Leeds target racked up 18 goals and 11 assists for the club's U18 and U21 sides combined as a central midfielder.

This shows that he loves to get forward to make a difference in the final third as both a scorer and a creator of goals, just like Klich did for the Whites under Bielsa.

It would be a gamble of a move from Leeds, however, as Clark has yet to prove his quality on a consistent basis at first-team level to date, but Klopp handing him plenty of opportunities last term speaks to his potential – as the German boss clearly deemed him ready to play in the Premier League and the Europa League.

It is now down to the club and Farke to convince Liverpool and Clark that a move to Elland Road is the best next step in his development for the 2024/25 campaign.

They touched down on Saturday and began training on Sunday after clearing their Covid-19 tests. This is the second time Zimbabwe and Pakistan are meeting since the Covid-19 pandemic was declared last March. Zimbabwe made a trip to Pakistan to play three ODIs and three T20Is in October-November last year. Pakistan won the ODI series 2-1 and the T20I series 3-0. “The Pakistan Cricket Board has been at the forefront of the revival of international cricket in the post-Covid-19 world and the tour of Zimbabwe is another step in that direction,” Zakir Khan, PCB director of international cricket, said in a statement. “We have always maintained that cricket and Covid-19 can co-exist in a safe and secure environment, and we continue to demonstrate this to ensure the game develops and flourishes in these difficult and challenging times.”The tour of our men’s side at the back of our women’s team first-ever visit of Zimbabwe is a testimony that the two boards – the PCB and Zimbabwe Cricket – enjoy excellent relations and are always ready to lend support to each other.
